Terms and Conditions

 

The following are terms of a legal agreement between you and 'The Apple Guy | Mark Tabor'. By using our computer repair service you acknowledge that you have read, understood, and agree to be bound by the terms below and to comply with all applicable laws and regulations.

'No fix - no fee'

'No fix - no fee' policy applies in those rare cases, when our staff is unable to fix a particular problem. If this is the case then you won’t be charged for triage.

The policy is not applicable, and you still will be charged for triage if:

• You prefer not to proceed with repairs after the problem has been diagnosed and a solution has been offered.
• You cannot provide our staff with legal licences.
• You cannot provide our staff with required passwords.
• The diagnostic is performed successfully but the problem is with a 3rd Party. For example, problems with the connection with your Internet Service Provider.

Limited Liability

'The Apple Guy | Mark Tabor' shall not be liable for any claims regarding the physical functioning of equipment/media or the condition or existence of data on storage media supplied before, during or after service.
In no event will 'The Apple Guy | Mark Tabor' be liable for any damage to the laptop/desktop, loss of data, loss of revenue or profits, or any special, incidental, contingent, or consequential damages, however caused, before, during or after service even if 'The Apple Guy | Mark Tabor' has been advised of the possibility of damages or loss to persons or property. 'The Apple Guy | Mark Tabor' liability of any kind with respect to the services, including any negligence on its part, shall be limited to the contract price for the services.
The client and 'The Apple Guy | Mark Tabor' agree that the sole and exclusive remedy for unsatisfactory work or data shall be, at 'The Apple Guy | Mark Tabor' option, additional attempts by 'The Apple Guy | Mark Tabor' to recover satisfactory data or refund of the amount paid by the client. The parties acknowledge that the price of 'The Apple Guy | Mark Tabor' services would be much greater 'The Apple Guy | Mark Tabor' undertook more extensive liability.
The client is aware of the inherent risks of injury and property damage involved in laptop/desktop repair, including without limitation, risks due to destruction or damage to the machine, media, or data and inability to repair the machine or recover data, including those that may result from the negligence of 'The Apple Guy | Mark Tabor', and assumes any and all known risks of injury and property damage that may results.

 

Confidentiality

'The Apple Guy | Mark Tabor' agrees not to disclose any and all information or data files supplied with, stored on, or recovered from client’s equipment except to employees or agents of 'The Apple Guy | Mark Tabor' subject to confidentiality agreements or as required by law.

 

Payment

Payment is due in full upon completion of successful repair, prior to release of the repaired machine

 

Warranty

90 days’ warranty on the hardware of laptops/desktops that 'The Apple Guy | Mark Tabor' has repaired, 'The Apple Guy | Mark Tabor' makes no warranty on data, express or implied, and 'The Apple Guy | Mark Tabor' disclaims any data warranty of any kind.

This warranty explicitly excludes coverage for any damage or issues resulting from customer mishandling or misuse of the device after the repair. It's essential for customers to exercise proper care and use of their repaired devices to maintain the integrity of the warranty and ensure its validity. This policy is in line with established practices in the industry, aimed at providing fair and reasonable warranty coverage for hardware repairs while holding customers responsible for the appropriate handling and usage of their devices post-repair.

Agreement

The parties shall submit all disputes relating to this Agreement (whether contract, tort or both) to arbitration, in accordance with the Rules of the UK business. Either party may enforce the award of the arbitrator in a Court of competent jurisdiction. The parties understand that they are waiving their rights to a jury trial. The arbitration shall take place in the Country in which the 'The Apple Guy | Mark Tabor' premises performing the services are located and the laws of the UK in which such premises is located shall apply.

 

Unclaimed Items
Any property left with 'The Apple Guy | Mark Tabor' unclaimed for 90 days, will be disposed of. At which time, 'The Apple Guy | Mark Tabor' shall have no liability to the client or any third party.
